
A High Court in Ghana has restrained the Economic and Organised Crime Office (EOCO) from maintaining a “wanted” declaration against Dr. Gabriel Kwamigah-Atokple, a member of the Council of State, and directors of his company, Sesi-Edem Company Limited. According to #JoyNews, the court’s decision stems from EOCO’s March 30, 2026, public notice declaring the directors as wanted persons while investigations were ongoing.
The court’s ruling emphasizes that EOCO acted beyond its legal mandate and breached the company’s right to administrative justice. Dr. Kwamigah-Atokple’s company had argued that the declaration was premature and unlawful, and the court agreed, ordering the immediate withdrawal of the “wanted” notice.
The dispute began with a petition filed by JG Resources Ltd in November 2025, alleging Sesi-Edem Company Limited failed to supply gold under a contractual arrangement. However, the court found that the matter was purely contractual and did not involve fraud or money laundering, thus falling outside EOCO’s investigative jurisdiction.
Dr. Kwamigah-Atokple has welcomed the court’s decision, stating that it vindicates his company’s stance. EOCO, on the other hand, had previously claimed that the company’s directors were being investigated for alleged fraud and money laundering.
The court’s decision marks a significant victory for Dr. Kwamigah-Atokple and his company, reaffirming their innocence and defending their reputation.
