Broken Promise: Court Orders GH¢200k Compensation for Breach of Engagement

 

 

A landmark ruling by Justice Sedinam Kwadam has sent shockwaves through Ghana’s legal and social circles, with a businessman being ordered to pay GH¢200,000 in compensation for breaching an 11-year engagement promise. According to 3NewsGH, the Accra Circuit Court ruled that the man’s assurances were not casual expressions of affection but constituted a serious and enforceable promise.

 

The case began as an ejectment suit against the woman, but the court ultimately found in her favor, recognizing her beneficial interest in the disputed property. The woman had argued that she invested substantial emotional, financial, and personal resources into the relationship, acting on repeated assurances of marriage.

 

Justice Kwadam noted that the ring given to the woman was not a casual gift but intended to signal commitment and deter competing suitors. The court also considered the fact that both parties are above 60 years old, and the woman’s prospects of finding another partner had been significantly reduced after devoting 11 years to the relationship.

 

The court awarded GH¢50,000 in general damages and GH¢150,000 in compensation, with an additional GH¢20,000 in costs. The woman is also permitted to continue residing in the East Legon apartment and using the Toyota RAV4 vehicle.

 

This ruling highlights the importance of understanding the implications of promises made in close relationships.
