The High Court has struck out the GH¢15 million defamation suit filed by Minority Leader Alexander Afenyo-Markin against GoldBod Chief Executive Officer Sammy Gyamfi. The court struck out the case over failure to comply with mandatory procedural requirements for libel actions.

Justice overseeing the case ruled that the plaintiff failed to satisfy the statutory pre-action protocols and pleading requirements that govern defamation suits in Ghana. The court held that the suit was not properly constituted in accordance with the High Court Civil Procedure Rules, and therefore could not be sustained. The GH¢15 million claim sought damages for alleged defamatory statements attributed to Sammy Gyamfi.

Afenyo-Markin, who is Member of Parliament for Effutu and Minority Leader, had filed the suit claiming that statements made by the GoldBod CEO were false, malicious and intended to injure his reputation. Sammy Gyamfi’s legal team had argued that the action was procedurally defective and urged the court to dismiss it at the preliminary stage.

In striking out the suit, the court awarded costs and noted that the plaintiff retains the right to re-file if he complies with the proper legal procedures for defamation. The ruling has sparked reactions on social media, with supporters of both political figures debating the merits of the case.

The case is one of several high-profile defamation actions involving politicians ahead of the 2028 political season. Legal analysts say the ruling reinforces the need for litigants to strictly follow procedural rules in libel cases, particularly the requirement to specify the exact defamatory words and provide particulars of malice.

As of press time, neither Afenyo-Markin nor Sammy Gyamfi had issued an official statement on the court’s decision. More updates are expected as the case develops.
