MFWA Decries Surge In False News Detentions

The Media Foundation for West Africa has condemned what it describes as a troubling escalation in arrests linked to alleged dissemination of false news since the current administration assumed office. According to #MFWA, the pattern of detentions raises serious questions about press freedom and the boundaries of lawful expression in Ghana’s democratic space.

The rights group contends that the increasing use of criminal procedures to address information disputes creates a chilling effect on journalism and public discourse. It argued that punitive responses risk conflating legitimate scrutiny with criminality, thereby discouraging citizens and media practitioners from engaging on matters of public interest. The foundation urged authorities to prioritize civil remedies and proportionate responses consistent with constitutional guarantees.

MFWA detailed several recent cases involving journalists, activists, and social media users who were apprehended and charged over content deemed misleading. While acknowledging the need to combat harmful misinformation, the organization stressed that any intervention must align with due process and international standards on freedom of expression. It called for transparent judicial handling and restraint in the use of custodial measures.

Contextualizing the development, MFWA recalled Ghana’s long-standing reputation for media pluralism and open debate across West Africa. The organization noted that previous governments had faced similar tensions, but warned that reverting to heavy-handed tactics could erode gains made in civic participation and institutional trust. It emphasized that robust public interest journalism often requires protection from intimidation.

The foundation concluded by urging Parliament and the judiciary to review existing provisions that criminalize speech-related offenses, advocating for reforms that balance national security concerns with fundamental rights. It expressed readiness to engage stakeholders in dialogue aimed at safeguarding both accurate information and democratic freedoms.
