Trump Administration Sues DC Over Gun Law

The Trump administration has filed a lawsuit against the local government of Washington, DC, alleging that the city’s restrictions on certain semiautomatic weapons violate Second Amendment rights. The US Department of Justice claims that DC’s gun laws are unconstitutional, citing the Supreme Court’s 2008 Heller precedent, which established an individual’s right to own firearms “in common use today.

The lawsuit targets DC’s ban on AR-15s and other semiautomatic weapons, arguing that these firearms are protected under the Second Amendment. The Justice Department states that the District’s restrictions are “based on little more than cosmetics, appearance, or the ability to attach accessories” and fail to consider whether the weapons are “in common use today” for lawful purposes.

The Trump administration’s lawsuit is the second gun-rights case filed this month, following a similar suit against the US Virgin Islands. The Justice Department is seeking to protect the rights guaranteed by the Second Amendment, which has been reaffirmed by the Supreme Court several times over the past two decades.

The Metropolitan Police Department has declined to comment on the lawsuit, citing pending litigation. The case is expected to spark a major legal battle over gun ownership regulations in the US.

This lawsuit marks another clash between the federal government and DC, which has been ongoing since the Trump administration launched a law enforcement intervention in the capital over the summer to address crime.
