Solomon Asamoah had asked the Supreme Court to restrain the High Court from continuing the trial after the High Court rejected his submission of no case. He contended that proceeding with the trial before the determination of his certiorari application to quash that rejection would prejudice his right to a fair trial and render his supervisory application nugatory.
In dismissing the injunction, the Supreme Court panel held that the High Court’s trial can proceed while the substantive application to quash the no-case ruling is pending. The court noted that an injunction to halt a criminal trial is an exceptional remedy that must be backed by clear evidence of irreparable harm, which was not demonstrated in this instance.
Howedey.com will continue to monitor the High Court proceedings as Solomon Asamoah and his co-accused are expected to open their defence. The outcome of his substantive application to quash the no-case decision is still pending before the Supreme Court.
